Terms and conditions (version April 1st 2009)

In order to become or to remain a member of The Carpooling Network by registering on any portals affiliated to it you must agree to abide to all of the terms and conditions contained in this Agreement.

Please read the following terms and conditions carefully, as they constitute the terms of Agreement between you and The Carpooling Network. If you do not agree to these terms and conditions, you may not use the service and should not proceed further. By using the services available on any portals affiliated to The Carpooling Network, you are agreeing to be bound by this Agreement, including all amendments made to date.

The Carpooling Network
The services offered by The Carpooling Network are available free of charge to individuals wishing to carpool. The use of this service is on a voluntary basis. The Carpooling Network is operated by COVOITURAGEMONTREAL Inc., a private company. COVOITURAGEMONTREAL Inc. acts as a means of contact between members wishing to carpool. The company is not in the business of transporting people.

Terms and Conditions
The Terms and Conditions are guidelines to ensure that anyone wishing to use the services offered by The Carpooling Network behave in a fair and responsible manner. These guidelines must be respected by the drivers and the passengers at all time.

The Carpooling Network may modify the terms and conditions without notice. Only in the case of major changes will the members will be notified, and it will be in their own responsibility to review the new version of the terms and conditions and make themselves aware of any modifications.

Disclaimer
COVOITURAGEMONTREAL Inc., the sponsors and the partners affiliated to The Carpooling Network release themselves from any liability for any incident and accident that may arise, directly or indirectly, due to the fact that two or more members have been in contact by using the services available on The Carpooling Network, regardless by which portal and in which circumstances they became members of The Carpooling Network. The member releases COVOITURAGEMONTREAL Inc., its founders, managers, partners, sponsors and employees of all complaints and prosecutions.

The member of The Carpooling Network acknowledges that COVOITURAGEMONTREALInc., the sponsors and the partners affiliated to The Carpooling Network are not responsible for the content of the messages which are been exchanged between the users. The files and the information provided by the individuals who register on the portals affiliated to The Carpooling Network are neither evaluated nor verified in any way. Use of the site is at user’s own risk.

Personal Information
Upon registration, individuals wishing to become members of The Carpooling Network agree to provide accurate personal information in order to ensure the effective operation of The Carpooling Network. Some of this information will be kept confidential in accordance with The Carpooling Network’s Privacy Policy. Each member has the responsibility to keep the information in his profile updated regularly.

The user allows the managers of the portals affiliated to The Carpooling Network to access the information stored in his profile, if necessary.

Using the service
This service can only be used for its original purpose, that of searching for people to find a carpool match. It should not be used in order to transmit any other material such as, and without limitation:
• incitement to hatred, violence or discrimination;
• pornographic and violent content or any content likely to impair the dignity of the human person;
• advertising, solicitation or invitation to go to another website address;
• content violating confidential information or an intellectual property right;
• content that is libellous, invasive of the privacy, harmful, obscene, constituting sexual harassment and in general for purposes which could adversely affect the rights of any third party.

The member of The Carpooling Network shall comply with all municipal, provincial and federal laws and regulations related to the transport of persons. It is in the member's responsibility to be aware of those laws and regulations.

Insurances
The driver certifies that the vehicle is insured and that his insurance contract includes a liability clause, which covers passengers in the event of an accident. It is the exclusive responsibility of the member to notify his insurer of his carpooling activities.

Trip planning and cost sharing

The use of the services available on The Carpooling Network cannot be used for commercial purposes. Cost sharing of transportation-related costs (fuel, toll, parking, use of the vehicle) by the members is made on a voluntary basis. The calculator tool provided to help members calculate the cost of transportation is only meant to serve as a guide.

Drivers and passengers agree to respect the terms set with other members with regards to cost-sharing, schedules and meeting places.

COVOITURAGEMONTREAL Inc., the sponsors and the partners affiliated to The Carpooling Network will not get involved in any manner nor take any responsibility in any terms set by and between members.

Security
Members of The Carpooling Network undertake to behave at all times in a responsible manner and respect of all laws and regulations.
